The Collapse of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the crisis triggered by the introduction of a new 28-point plan for resolving the conflict appeared – briefly – to have been defused. A American diplomat spoke of "significant advancement" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its retaliation: a renewed assault of missile and drone strikes on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of opposing developments captured the bleak nature of the outgoing year. By day, political struggles are fought: positive announcements are released from different nations. Immense energy is expended on managing particular approaches. By night, Russian leadership forcefully demonstrates the world that, for them, conflict continues to be the main instrument for achieving "peace".

Nocturnal Warfare

As the offensive developed into the early hours of Tuesday, the current condition of Ukraine's exposure was exposed. Ukraine is able to track projectile deployments from Russian territory, a capability provided through timely intelligence. From vantage locations, Ukrainian air force fighter jets that had been scrambled to engage hostile guided weapons roared overhead – advanced fighter aircraft provided to Ukraine by Western partners.

Shortly after, Kyiv's air-defence systems activated: several firings targeted at a hostile projectile. This was a sophisticated defense system at work, presumably provided by partner states. Every firing jolts you unexpectedly, shaking the windows. The instant of fear quickly gives way to resigned acknowledgment: perhaps the hostile projectile won't strike its target this time, protecting urban areas from devastation and additional electricity failures.

Persistent Threats

Not long after, a heavy machine gun opened up on a drone somewhere nearby, part of a mobile-fire group – probably allied-provided weaponry. Regrettably, the shots failed to hit the enemy aircraft – it continued its flight toward its target.

With pauses, this persisted until dawn. Kyiv awoke to the daybreak reports: seven people killed, destruction and utility failures in many homes as a result of the night's assault. As typically, everyone still maintained normal activities – living the war. But those full day encapsulated Ukraine's vital need on international aid – a reliance that regional partners are evidently unprepared to replace in the short term.

Unsuccessful Negotiations

The detailed framework from American leadership sparked intense emotion, controversy and deep concern – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and multilateral gatherings.

Every new initiative from Washington unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, manages to fend off. They stabilise the situation but never actually achieve victory. This trend will, undoubtedly, endure.

Political Considerations

It is tempting to accuse certain parties of consistently pushing Russian terms. But that does not seem to be the whole story. American leadership functions according to a principle understood by seasoned negotiators: you cannot achieve through diplomacy what you have lost on the battlefield. The White House assumes that it is unfeasible to pressure the Kremlin to abandon the land that it currently occupies in Ukraine's southern or eastern regions.

The issue is that while recognising this factual reality, Washington does little to prevent Kremlin actions, through diplomacy or military means, from assuming that the current condition will not change more in its favour in the near future.

Divergent Views

Therefore, Moscow is certain that time is on his side – that Ukraine and its supporters are approaching exhaustion. Their motivation to agree to terms that does not give them the largest achievable advantage is virtually nonexistent. There may be many attempts to stop fighting, but they will continue as long as Russia's leadership remains supremely confident in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still endure, gradually sacrificing lives and land but preventing a total frontline collapse until situations evolve in its benefit.

Present Conditions

Objectively, there are no actual prerequisites for a ceasefire. Now, subjective factors are becoming relevant: personal goals to negotiate peace and achieve global acclaim, and Kyiv's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the flag against any proposal Kyiv finds unacceptable, so that their focus does not shift toward homefront challenges. And although their mission will now be considerably more difficult after current events, it remains quite doubtful that this will change their overall approach.

These conflicting dynamics are guiding negotiations.

Assessment and Future

It took a mere seven days to kill the suggested clauses of the most recent proposal. Aggressive and erratic handling of the matter by US administration, opposition by Ukraine and the remaining European nations, along with pacifying measures of diplomats, and finally, latest revelations, all did their job.

While new plans based on old ideas are approaching, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are founded on Moscow's terms and show particular unwillingness to change the course of events, if they stand together and strengthen their defence capabilities at a much faster pace. If they do, neither external pressure nor military threats will be able to break them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the foreseeable future, largely rely on ongoing international assistance.
